Agreement to Terms
By accessing or using the Swag Crate website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our website or services.
Services Description
SWAGTAINER, LLC provides custom promotional products, branded merchandise, and related services including design, production, packaging, and fulfillment. All services are subject to agreement and order confirmation.
Orders and Payment
- All orders must be confirmed in writing with an approved quote or purchase order.
- A deposit may be required before production begins, with the balance due prior to shipment.
- Prices are quoted per unit and may vary based on quantity, customization, and materials.
- Payment methods include credit cards, wire transfers, and checks as agreed.
Artwork and Intellectual Property
- Clients are responsible for providing artwork that they have the right to use.
- Design proofs are provided for approval before production begins.
- Final approval of artwork constitutes acceptance of design, colors, and layout.
- All design concepts created by Swag Crate remain our intellectual property unless otherwise agreed.
Production and Delivery
- Production timelines are estimated and may be affected by material availability, order complexity, and volume.
- We strive to meet all agreed delivery dates but are not liable for delays caused by factors beyond our control.
- Shipping costs and methods are specified in the order confirmation.
- Risk of loss passes to the buyer upon delivery to the carrier.
Returns and Refunds
- Custom products are made to client specifications and generally cannot be returned.
- If products arrive damaged or defective, we will replace them at no charge.
- Claims for damaged or missing items must be reported within 5 business days of receipt.
- Non-custom items may be returned within 14 days in original condition.
Limitation of Liability
SWAGTAINER, LLC liability for any claim arising from our services is limited to the amount paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or business interruption.
Prohibited Uses
You agree not to use our services to produce products that infringe on third-party intellectual property rights, contain unlawful or offensive content, or violate applicable laws or regulations.
Governing Law
These terms are governed by the laws of the State of Connecticut, United States. Any disputes shall be resolved in the courts of Middlesex County, Connecticut.
